BILL RIVARD AND JEFF SCHULTZ OBTAIN SUMMARY DISPOSITION IN AUTOMOBILE NEGLIGENCE CASE

Earlene Love v. Ashton Masar, Genesee County Circuit Court. The plaintiff filed an automobile negligence lawsuit against our client, alleging that she sustained serious injuries as the result of a motor vehicle accident. We moved for summary disposition, arguing that the plaintiff had failed to demonstrate a serious impairment which was caused by the accident and her pre-accident lifestyle had not been altered by her alleged injuries. The Court granted our motion via a written opinion, finding that the plaintiff had not been able to establish that her impairments arose from the subject accident and not her documented pre-accident disability and/or a subsequent motor vehicle accident she was involved in.
