Michael F. Schmidt And Nate Peplinski Obtain Summary Disposition In Coverage Case

In Safeco Insurance Company of America v Sebastien Lebon, Matthew Kamps and Yreva Muhammad, Personal Representative of the Estate of Robert Muhammad, Deceased, we filed a declaratory action to determine there is no duty to provide coverage or a defense to Lebon or Kamps for the wrongful death suit filed against them arising out of alleged injuries incurred by injuries and death of Robert Muhammad. We argued that pursuant to the policy there was no coverage because there was no “occurrence” and coverage was excluded by the intentional act exclusion. After filing a motion for summary disposition the court entered a declaratory judgment that Safeco had no duty to provide coverage or a defense to Lebon or Kamps for any claims made against them in the underlying action.
