Commercial and Business Disputes

Since the founding of Harvey Kruse, PC in 1969, we have successfully defended various clients in both straightforward and complex commercial disputes. We provide comprehensive and highly-tailored representation at every stage of legal matters and are committed to engaging closely with clients throughout the process to ensure that their best interests are served regardless of case developments.

The attorneys in our commercial and business litigation practice offer our clients the significant breadth and depth of their experiences handling difficult, varied litigation in the commercial context. We offer representation to clients who require assistance in the following matters:

  • Contract disputes
  • Business Torts
  • Unfair competition
  • Advertising liability
  • Negligent misrepresentation
  • Intellectual property disputes
  • Construction contract disputes
  • Partnership disputes
  • Class and collective actions
  • Bad faith disputes
  • Insurance coverage
  • Overtime
  • And more

We litigate all types of cases under the Uniform Commercial Code and we regularly appear in equitable actions (involving the enforcement of supply contracts). In addition, we defend manufacturers in cases arising under statutes such as federal and state consumer protection laws or laws regulating trade practices. We also represent clients in a variety of sophisticated contract disputes arising out of sales of goods, the purchase and sale of businesses, utility contracts, the transfer or licensing of intellectual property, construction contracts, overtime disputes, and partnership disputes.

Many of these engagements involve class actions, multi-district litigation or appearances before regulatory bodies or administrative agencies. We have developed the expertise necessary to undertake issues at every stage of trial practice (and relevant regulatory processes), from preliminary injunctions all the way through to final verdict.

We routinely help commercial clients navigate disputes in furtherance of their organizational interests, and as such, we take a holistic approach to legal advocacy. When defending a client in litigation, we invest significant time, effort, attention, and resources so that we can provide effective insights into how legal case dynamics might impact their commercial interests.

Over the course of six decades, we have gained key insight into the cost-related factors that might otherwise limit a client’s ability to properly litigate their defense. We have pioneered efforts to develop faster, more economical mechanisms to resolve commercial disputes outside of traditional litigation, and counsel clients on alternative dispute resolution techniques that can lead to a more favorable overall result. We are able to implement a number of cost-containment strategies to ensure that our clients receive high-quality representation regardless of their budgetary constraints. Unlike many of our competitors, we do flat-fee agreements, which can limit excessive spending when handling issues of substantial scale. We staff cases efficiently and identify the issues central to a dispute early on, which ensures that we have ample guidance on how to proceed so as not to waste unnecessary resources.

If you are involved in a commercial or business dispute, we can help. Contact one of our experienced attorneys for comprehensive guidance on all the options available to you to best resolve your case.
