Jason R. Mathers Wins Motion for Summary Disposition in Wrongful Death Case

Estate of Arthur Mccray, Jr. v. Kyle Smith, Macomb County Circuit Court, Case no. 2024-000517-NI. This wrongful death case arose out of a motor vehicle versus bicyclist accident. We successfully argued that the plaintiff Estate had failed to raise any genuine issue of fact that the defendant driver was negligent in causing the accident, and alternatively that the deceased bicyclist was more than 50% comparatively negligent for entering into the intersection against the red traffic light, outside the crosswalk, and while under the influence of alcohol.
