Michael F. Schmidt And Nate Peplinski Obtain Summary Judgment In Another Provider Suit

1st Care Transportation, Inc. (Jonathan Lamb) v Integon National Insurance Company and National General Insurance Company, 19th District Court. This was a provider suit filed seeking recovery of medical expenses incurred for claimant Jonathan Lamb. We filed a motion for summary disposition on the basis that the claim was based on a policy of insurance which was rescinded based upon misrepresentations made in the application. The plaintiff filed a response brief, and after hearing oral argument, the trial court granted summary disposition finding that the claim was barred by the rescission of the policy based upon misrepresentation made in the application.
