MICHAEL F. SCHMIDT AND NATHAN PEPLINSKI OBTAIN MICHIGAN COURT OF APPEALS AFFIRMATION OF SUMMARY DISPOSITION ON DOMICILE CASE

Home-Owners Insurance Company v Liberty Mutual Insurance Company and Central Mutual Insurance Company, Michigan Court of Appeals, unpublished per curiam decision of the Michigan Court of Appeals Docket No. 345627 (2019), 2019 WL 6799719.  We obtained a summary disposition in favor of defendant Liberty Mutual as to plaintiff insurer’s attempt to obtain reimbursement of $622,000 in no-fault benefits.  The Court of Appeals ruled that the trial court correctly determined that domicile was established with Home-Owners’ insured and not Liberty Mutual’s insured, specifically rejecting Home-Owners’ argument that there had to be intent to make domicile permanent, agreeing with our argument that domicile could be established by an intent to have a particular domicile for an indefinite or unlimited length of time.
