Michael F. Schmidt Obtains Dismissal Of Third Party Auto Case As Sanction For Plaintiff’s Failure To Comply With Discovery Order

Denishia Lewis v Avis Budget Car Rental, LLC and Alisha Barnes, Wayne Court Circuit Court, claim by Denishia Lewis against Alisha Barnes for injuries allegedly incurred from alleged auto accident. We filed discovery requests on behalf of Alisha Barnes which Lewis did not timely answer. We filed a motion to compel and obtained an order compelling the answers. When the order was not complied with we filed a motion to dismiss for the failure to comply with the court’s discovery order. The court held a hearing on the motion and ordered that the plaintiff appear at a subsequent hearing date. The plaintiff failed to appear and the court then granted our request to dismiss the case with prejudice.
