Michael F. Schmidt Obtains Judgment Of No Insurance Coverage In Favor Of Insurer

Harleysville Lake States Insurance Company v Alexander Comparoni and Encompass Insurance Company, Oakland County Circuit Court, we filed a declaratory complaint on behalf of Harleysville Lake States Insurance Company against Alexander Comparoni and Encompass Insurance Company alleging that the Harleysville homeowner policy issued to Comparoni did not provide coverage to Comparoni for a subrogation claim made against him by Encompass Insurance Company for an alleged multi-million dollar fire. We argued that coverage was excluded by multiple exclusions including “property damage” arising out of or in connection with a “business” engaged in by an insured. We obtained a judgment against Comparoni and a default judgment against Encompass that Harleysville had no duty to provide coverage or a defense to Comparoni for the underlying claim.
