Michael F. Schmidt Obtains Summary Disposition That There Was No Uninsured Motorist Coverage Applicable To The Plaintiff’s Claim

Tiffany Buchanan V MemberSelect Insurance Company, et al, Wayne County Circuit Court Civil Action Number 14—00099-NI, claim by plaintiff for uninsured motorist benefits arising out of an auto accident in which plaintiff was a passenger in her own vehicle involved in an intersection accident. The plaintiff sued the driver of her vehicle and the driver of the other vehicle involved in the accident along with her own insurer MemberSelect Insurance Company. The claim against MemberSelect Insurance Company sought uninsured motorist benefits. We filed a motion for summary judgment on the basis that the plaintiff’s insured vehicle and the opposite vehicle did not meet the policy definitions of an “uninsured motor vehicle”. The trial court agreed and granted summary disposition as to all claims by the plaintiff for any uninsured motorist benefits.
