Summary Disposition Obtained By Michael F. Schmidt In Claim For Uninsured And Underinsured Motorists Benefits

Brandon Davis v Nationwide Insurance Company, et al, Wayne County Circuit Court, claim by plaintiff for uninsured and underinsured motorists benefits arising from a one vehicle accident in which the plaintiff was a passenger and claimed uninsured and underinsured motorists benefits. We responded with a motion and brief for summary disposition on the basis that the vehicle did not meet the policy definition of an uninsured or underinsured motor vehicle and that even if the vehicle met the definitions, various exclusions applied. The court agreed and granted summary disposition that there was no coverage available.
